SECTION 11 - SHOPIFY

Lu-Vie uses Shopify to host and operate its online store.

Shopify provides the technology and infrastructure that enable us to offer the Services. However, purchases made through the Lu-Vie store are transactions between the customer and Lu-Vie.

Shopify is not the seller of Lu-Vie products and is not responsible for fulfilling orders, providing product warranties or handling customer claims relating to Lu-Vie products, except to the extent that Shopify separately provides a service directly to you.

Your use of certain Shopify features may also be subject to Shopify’s own terms and privacy practices.

  • Your infringement of another person’s rights; or
  • Content or information unlawfully submitted by you.

This indemnity does not apply to the extent that a loss was caused by Lu-Vie’s unlawful conduct, gross negligence or other conduct for which liability cannot legally be excluded.

SECTION 20 - CONSUMER RIGHTS

Nothing in this Legal Notice is intended to exclude, restrict or waive any consumer right or remedy that cannot legally be excluded, restricted or waived.

Where any part of this Legal Notice conflicts with a mandatory provision of the Consumer Protection Act or another applicable law, the mandatory legal provision will prevail.

Nothing in this section prevents a customer from approaching an appropriate consumer, regulatory or dispute-resolution body where entitled to do so.

SECTION 22 - GOVERNING LAW AND JURISDICTION

This Legal Notice and your use of the Services are governed by the laws of the Republic of South Africa.

Subject to applicable consumer-protection legislation and any right you may have to approach another competent forum, disputes will be subject to the jurisdiction of the competent South African courts.

Nothing in this section deprives a consumer of any right to institute proceedings in a forum or jurisdiction permitted by applicable law.

SECTION 23 - SEVERABILITY

If any provision of this Legal Notice is found to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.

The remaining provisions will continue to remain valid and enforceable.

A failure or delay by Lu-Vie to exercise any right under this Legal Notice does not constitute a waiver of that right.

Any waiver must be made expressly and in writing by an authorised representative of Lu-Vie.

We reserve the right to amend, update or replace this Legal Notice from time to time.

The latest version will be published on this page together with the date on which it was last updated.
